Eviction Cost
The good with the bad. In life you always have the good with the bad. Same goes with real estate, things will happen. Repairs will need to be made, people might stop paying rent. It just goes with the nature of the game. What do you do when you have a client that stops paying rent? Do you have the right paper work? Did you have the contract done correctly? Were you clear when you dropped off the 3 day notice to vacate? A lot goes into an eviction.
Lets start in the best case, you have a house and you lease it out. The person is happy to have a place to live and pays you rent on time. Month in and month out till the lease is up. Most leases are one year long. After the first year you and set up other year lease, have the client move out or go month to month with that client.
From time to time you will have a client that will stop paying rent. I have been doing this for a long time. I have heard so many reasons for a client not being able to pay rent. But at the end of the day, they have a place to live and they need to pay rent. Thats that simply. Below I will talk about Texas and only Texas. Each state has its own laws.
In Texas if you have a lease. Your client has a rent due days. Most of the time its the first of the month. But it can be any date of the month. Lets say the due date is the 1st day of the month. If rent isn’t paid on the 1st, you are able to give them a 3 days notice to vacate. This notice has to be done in person , or mailed certified. The 3 day notice to vacate states the client has thee days to pay or get out. After 3 days if the client is still in the house, you have to go to court. You go to the county the house is located. Once at the court house you have to pay. Nothing is free, the cost for Texas is $121. Once you pay your money order. They will let you know when your court date is. During this time a cop will come out to the house and let the client know about the court date.
If you have done everything right. You should have no problem in court. The first time I ever had to go to court I had a lawyer. That was my only time I had ever done this. Now I know the things I need to bring and the fact that we always take care of our clients. The bottom line is that you have to do the right things. Once you have a client stop paying rent. Make sure you get the 3 day notice out ASAP.
